These Terms govern your use of the SocialPerks web app and iOS/Android app (together, the "Service"). By creating an account, you agree to them. They describe the Service as it actually works today.
SocialPerks helps a venue fill hours that would otherwise run empty, through its own customers. A venue chooses one small gift it is willing to give and the hours it wants to fill. A customer who takes the offer gets a personal link; they receive the gift when, during their visit, they show the venue's staff a Story or post they published, or an invitation they sent, carrying that link, and the staff confirm the visit with the customer's code. Coming without sharing is welcome, without the gift. Each friend who comes through a link can take the same offer on the same terms. SocialPerks writes the wording and the images, works out whether the gift pays at the venue's own prices, and counts the visits that arrive, including those each customer's link brings. It does not take a commission, and it is not a booking platform.
You must provide accurate information when you sign up. You are responsible for keeping your login credentials confidential and for everything done under your account. You must be old enough to enter a binding agreement in your country of residence. A venue account may only be created by somebody authorised to act for that venue.
The venue decides every reward and every limit, and approves a Perk before anything goes out: we never publish without that approval. The venue is responsible for honouring the reward it approved, for the accuracy of what it offers, and for serving customers lawfully, including any obligation it has under food, alcohol, hygiene or consumer law. SocialPerks does not guarantee any number of visits, and says so on the page where a Perk is approved; the refund in section 5 is the only commitment it makes about results.
Nobody has to share anything to visit a venue; the offer's gift is for a share, and the customer sees that condition before taking the offer. The gift never depends on what a post says: no review, rating, follow or favourable opinion is ever asked for, and there is never a reward for a review. A private invitation sent to people the customer knows counts as much as a public post. Where a customer does post, the post is their own: they write it, they own it, and they can delete it at any time without losing a gift already given. Because the law in Spain and elsewhere treats a reward connected to a post as advertising that must be labelled, the customer's prefilled text opens by saying it is an ad and the Instagram sticker shows ad.socialperkses.com; the venue remains responsible for any labelling obligation that applies to it, and SocialPerks never tells anybody to hide that a gift was involved. We never read, verify or take copies of a customer's posts or social account: a member of the venue's staff looks at the customer's phone. The customer sends their link themselves, only to people they know: SocialPerks never sends a message on their behalf or collects their friends' contacts, and the gift is one per customer per offer, never one per friend or per message. Where the law restricts alcohol as a reward (the United Kingdom, Ireland, New Zealand, Australia, the United States), alcoholic gifts do not go out; elsewhere they are for adults only. In the United Arab Emirates gifts for sharing are paused until a local legal check.
SocialPerks costs €49 per venue per month, excluding VAT. That is the whole price: there is no setup fee, no commission, no charge per visit and no higher tier. The first week is free: a card is taken when the plan starts, the first charge lands when the week ends, and cancelling inside the week costs nothing. New-customer guarantee: if, in a calendar month of paid plan (in the venue's own time zone), fewer than three new customers come in through the links of the venue's customers, we refund that month's fee in full, to the card that paid it, within 14 days of the month's end. A new customer is a person who took an offer through another customer's link and was checked in at the venue with their own code during that month; visits checked in by hand, link openings, clicks and claims do not count. The guarantee applies to a month in which the venue had at least one offer live, and the count is the one the venue sees in its console. A subscription renews monthly until cancelled. A venue can cancel at any time itself, from its plan page; no email to us and no notice period. Cancelling stops future charges, and the subscription then runs to the end of the month already paid for: the venue's Perks keep working until that date, and stop after it. Apart from the guarantee above, we do not refund a month already started. Payments are handled by Stripe. Outside the euro area, the payment page can show and charge the price in the venue's local currency, converted by Stripe at that day's rate with its conversion margin; the amount charged is the one that page shows. Prices may change, and we will tell a venue before a change takes effect on it.
A customer who claims a Perk is expected to turn up and to be who they said they were. Claiming a place and not arriving costs nobody anything, but repeatedly doing so, claiming on behalf of people who do not exist, or trying to redeem the same reward twice is a breach of these Terms. Rewards are offered by the venue, not by SocialPerks: we never hold, sell or guarantee one, and a dispute about a reward is between the customer and the venue, though we will help where we can.
Do not use the Service to harass anyone, to misrepresent a venue you do not own, to claim visits that did not happen, to inflate what a link reports, or to reach another user's account or another venue's data. Do not attempt to break, overload or probe the Service except with our written permission.
You can delete your account at any time from the account page. We can suspend or terminate an account that breaches these Terms, in particular for claiming visits that did not happen or for impersonating a venue. If we terminate an account that has paid, we refund the unused part of the current month unless the termination was for fraud.
The Service is provided "as is". The figures it shows, what an hour is likely to do, what a reward is likely to cost, what a Perk returned, are estimates built from a venue's own numbers, and the Service says so where it shows them; they are not a promise of a result and must not be relied on as one. SocialPerks is not a party to what happens between a venue and its customers inside the venue. Nothing in these Terms limits liability that cannot lawfully be limited, including for death, personal injury or fraud, or any statutory right a consumer has.
If we make material changes to these Terms we will update the date above and, where required, tell you directly before they take effect. These Terms are governed by Spanish law, and the courts of Barcelona have jurisdiction, except where a consumer is entitled to bring proceedings where they live. SocialPerks is being incorporated as a Sociedad Limitada in Barcelona; full registration details will be published here once that is complete.
